These Terms and Conditions ("Terms") govern your use of the Solix Listings website and the services offered by Solix Realty LLC, doing business as Solix Listings ("Solix Listings," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms. Please read them carefully.

1. About Us
Solix Listings is a service of Solix Realty LLC, a licensed Oklahoma real estate brokerage. We provide flat-fee real estate listing services to home sellers in the Oklahoma City metropolitan area.

2. Our Services
We offer two primary service options:

Flat Fee MLS Listing: A flat-fee listing package that includes the services described on our website, such as MLS entry, professional photography, marketing tools, and related services. With this option, the seller is responsible for handling showings, buyer and agent communications, offers, and negotiations, except as otherwise provided.

Full-Service Flat Fee: A full-service listing package that includes the services in the Flat Fee MLS Listing plus full representation from listing through closing, including showing management, marketing, negotiation, and transaction coordination, as described on our website.

The specific services included in each package are described on our website and in your listing agreement. In the event of any conflict between these Terms and your signed listing agreement, the listing agreement governs.

3. Payment Terms
Flat Fee MLS Listing: Payment is due upfront. Fulfillment of your listing (including scheduling photography and entering your home on the MLS) begins after payment is received.

Full-Service Flat Fee: This fee is paid at closing, only upon the successful sale and closing of your home. If your home does not sell, no full-service fee is owed. This contingent fee is earned and payable upon closing, and is subject to the terms of your listing agreement, including any protection-period and procuring-cause provisions described therein.

All payments are processed through secure third-party payment processors. You agree to provide accurate payment information.

4. Refund and Cancellation Policy
Flat Fee MLS Listing: The fee is refundable only before photography has been scheduled. Once photography has been scheduled, the fee is non-refundable, as we begin incurring costs and committing resources to your listing at that point. By scheduling your photography, you acknowledge and agree that the fee becomes non-refundable. No cancellation fee applies to the Flat Fee MLS Listing.

Full-Service Flat Fee: Because the full-service fee is paid at closing, cancellation is governed by the terms of your listing agreement. If you cancel or terminate a full-service listing before its expiration for any reason other than our material breach, a cancellation fee of up to $600 applies to reimburse us for professional photography, staging consultation, and other services and costs already provided or incurred on your behalf. This $600 cancellation fee is due upon termination and is separate from, and in addition to, any compensation that may be owed under the protection-period provisions of your listing agreement. This fee does not apply if you cancel due to our failure to perform our material obligations under your listing agreement.

5. Upgrade Credit
If you begin with the Flat Fee MLS Listing and choose to upgrade to the Full-Service Flat Fee within thirty (30) days of your listing going live, we will credit the cost of the flat fee listing toward the full-service fee at closing. The flat fee listing cost is credited, not refunded, and the credit applies only at closing upon a successful sale. Upgrades requested after the 30-day period may not qualify for the credit.

6. Listing Guarantee
We offer a listing guarantee that your home will be entered on the MLS within 24 hours of your completed photo shoot, provided that all required listing documents, disclosures, and information have been completed and submitted to us, and that your property and listing are ready for entry. This guarantee is contingent on your timely cooperation in providing required materials and approvals. The remedy for any failure to meet this guarantee, if any, is as stated on our website or in your listing agreement.

7. Buyer's Agent Compensation
Our fees cover listing-side representation only and do not include any compensation you may choose to offer a buyer's agent. Buyer's agent compensation is negotiable and decided by you, and is paid separately at closing if offered. Please see our Disclaimer page for important information about buyer's agent compensation.

8. Seller Responsibilities
You agree to provide accurate, complete, and truthful information about your property, including all material facts and required disclosures. You are responsible for complying with all applicable laws regarding the sale of your property, including disclosure obligations. You agree to cooperate in providing documents, approvals, and access necessary for us to perform our services. Solix Listings is not responsible for delays, losses, or consequences arising from inaccurate information or failure to provide required materials.

9. No Guarantee of Sale
Except for the specific listing-entry guarantee described above, we do not guarantee that your home will sell, sell within any particular timeframe, or sell at any particular price. Market conditions, pricing, property condition, and buyer demand affect the outcome of any sale.

10. Website Use
The content on this website is provided for general informational purposes. Savings examples, calculators, and estimates are illustrative only and do not reflect the actual costs or proceeds of any specific transaction. You may not use our website for any unlawful purpose or in any way that could damage, disable, or impair the site.

11. Intellectual Property
All content on this website, including text, graphics, logos, and the Solix Listings name and branding, is the property of Solix Realty LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without permission.

12. Limitation of Liability
To the fullest extent permitted by law, Solix Realty LLC and its members, agents, and affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim arising from our services shall not exceed the fees you paid to us for the service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Not Legal, Financial, or Tax Advice
Information provided on our website or by us is not legal, financial, or tax advice. You should consult appropriate licensed professionals regarding your specific situation.

14. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles. Any disputes shall be subject to the jurisdiction of the courts located in Oklahoma.

15. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
